Terms of Use

1. Purpose of the Agreement

This User Agreement ("Agreement," "User Terms," or "Terms") sets out the legal agreement between you ("User," "Visitor," "Member," or "you") and complaints.ae ("Complaints.ae," "complaints.ae" or "we"), governs your use of the Complaints.ae website, mobile application or any other platform related (collectively the "Platform").

By accessing or using the Site and/or any other subdomain, subdirectory, similar platform, website, or application operated or provided by the Site or Complaints.ae, you acknowledge that you have read, understood, and agreed to be bound by this Agreement and any additional rules, policies, or terms that may apply. It is essential that you carefully read these terms of use before starting to use the Site. If you do not agree to abide by these terms and conditions and have already started using them, you must immediately cease using them.

This agreement may be modified as deemed necessary. The new terms will take effect once they are published online by Complaints.ae. By continuing to use or access the system, you signify that you accept the updated agreement as final. The user is responsible for keeping track of any changes made to the agreement.

The user undertakes to familiarize themselves with the new version of the user agreement each time they visit the site and before using the site and/or their personal account. The continuous use of the site and the personal account implies the user's acceptance of the current version of these terms.

You must only continue using the site if you explicitly accept the conditions below. The agreement's provisions are accepted fully and unconditionally without any reservation, modification, or exception.

 

2. Scope of the Agreement

Complaints.ae, as a complaint and solution platform accessed over the internet, aims to increase the quality of goods and services by acting as a bridge between those who have complaints about the goods or services they receive and those who provide these goods and services. This agreement covers the contractual provisions that users who want to use the site and other services for this purpose will be bound by. Therefore, by visiting the Complaints.ae system, seeking information, sharing content, and/or using it to submit complaints to goods or service providers, users acknowledge, declare, and undertake to be bound by the provisions within the scope of this agreement.

While users are granted permission to use the site subject to the limitations set forth in these terms, the use of the site remains the user's responsibility. The user is solely responsible for any disagreeable situations encountered, including the risk of exposure to offensive, inappropriate, inaccurate, objectionable, or otherwise unsuitable content.

Complaints.ae reserves the right to modify, update, interrupt, suspend, or terminate the entire site's content and activities at any time and without notice or obligation.

 

3.Age Limitation / Eligibility

You must be at least 13 years old to use the site. By using the site, you declare and warrant that you meet these eligibility requirements.

 

4. Accounts

To access certain features of the site and related platforms, you need to create an account ("Membership"). You must be at least 18 years old to create an account on the site or be of legal age to enter a binding contract in your country of residence. If necessary, you may be asked to provide proof of your age.

Accounts are for personal, non-commercial use only. Users can browse Complaints.ae without registering. However, creating an account is mandatory to access certain functions of Complaints.ae.

When registering for the system, users concur, declare, and undertake to sign up as a member through the "sign up" section and provide all the requested information accurately and completely. The MEMBER acknowledges, declares, and agrees to be liable for any damages incurred by Complaints.ae or any third party due to incorrect or incomplete information submission.

The MEMBER acknowledges that they assume all responsibility and risks arising from the use of the system. Complaints.ae does not provide any explicit or implied warranties regarding any service, information, or system content provided through the system or the use of any element or system in any way. It is solely the responsibility of the MEMBER to evaluate the accuracy, completeness, and usability of all thoughts, advice, services, or other information and materials provided through Complaints.ae

The member is solely responsible for maintaining the password's security and confidentiality. The user is not permitted to share this information with third parties. The member is solely responsible for any issues that may arise from their or third parties’ use of this data. All transactions performed using the User's Login Information and Password are presumed to have been performed by the User. Members who discover that their user information has been used fraudulently must promptly notify the Complaints.ae administration. The process of notifying users does not imply the conclusion of culpability for the use of user data. The information provided by each member on the Complaints.ae site's registration form is regarded as accurate. If it is determined that this information is insufficient, incorrect, or fraudulent, the membership will be terminated or blocked, and access to the Complaints.ae services will be restricted.

The member may not use their membership or the Complaints.ae system for any purpose that is illegal, disrupts public order, goes against general morality, harasses or disturbs others, or violates the intellectual and copyright rights of others. In addition, the member shall not engage in any action or conduct that prevents or impedes others from utilizing the services provided by Complaints.ae, or that violates the aforementioned restrictions. The member hereby acknowledges, declares, and agrees to abide by the foregoing restrictions.

In the event of a violation of these rules, the accounts opened may be canceled. The user is responsible for all activities and password security related to their account. If unauthorized access by someone other than the member is detected, the situation should be reported to support@complaints.ae.

In addition, the member cannot access or use the site if they are in a competitive relationship with the site, have been previously prohibited, or have had their account closed.

The member has the right to delete their account at any time, but this does not guarantee that the information will be automatically removed from the site. Although the member can terminate or modify their account at any time through account settings, Complaints.ae is allowed to retain certain information as required by law and for legitimate business purposes as long as necessary.

Complaints.ae reserves the right to suspend a member's membership or terminate the membership contract at any time and without explanation. The member acknowledges, declares, and agrees that, in the event of suspension or cancellation of membership, they’ll have no claims against Complaints.ae and waive all rights to legal action and claims.

 

5. User Content

"Content" means text, images, photos, audio, video, and all other forms of data or communication. Content covers all information submitted or transmitted to, through, or in connection with the Site, such as ratings, reviews, compliments, invitations, messages, and information that you publicly display or is displayed in your account profile. "User Content" or "Member Content" means Content that other users submit or transmit to, through, or in connection with the Site.

Complaints.ae always assumes that the consumer has a positive intent in writing their message, helping themselves, helping other consumers, and helping the subject business provide a better product or service.

Complaints.ae assumes that "User Content" is a description of a situation experienced by a consumer. A complaint or review is only an opinion by a consumer, a perception of a consumer. Although the input is edited in line with the terms, Complaints.ae can’t be held accountable for how information is interpreted by whoever reads it. It is the responsibility of the mentioned message author to determine on their own if they are not allowed to discuss the subject of their complaint or review or have permission to upload related documents, if this is the case, before posting a message to Complaints.ae.

 

6. Behavioral Patterns and Prohibited Uses

You agree to use the platform only for lawful purposes and in accordance with all applicable laws, also along with the rules and policies of Complaints.ae. You agree not to engage in conduct that violates the rights of others or is detrimental, harassing, abusive, or otherwise unacceptable.

Using the Site, you declare, commit, and agree not to:

  • violate any applicable domestic or international laws or agreements.
  • transmit any content that is illegal, detrimental, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, or invasive of another's privacy rights or that in any way may result in legal or criminal liability.
  • represent yourself as a representative of any person or entity, including the owner(s), officials, or the host of Complaints.ae, in a way that could cause confusion or misrepresentation.
  • modify or remove any content from Complaints.ae, including text, images, graphics, registered trademarks, trade names, and names.
  • introduce or transmit any malicious codes or materials, including viruses, trojan horses, spyware, and dialer programs.
  • use the system's communication features to restrict or destroy other USERS' ability to access or use them.
  • place or transmit any unsolicited advertising, promotional materials, junk mail, spam, chain letters, commercial texts, images, sounds, graphics, or any other commercial materials.
  • use framing or similar browsing technologies to redirect or display the system for their own purposes.

The USER agrees that they will not infringe upon the reputation, commercial reputation, trademarks, fame, honor, and all other personality rights of any natural or legal person through the complaints they submit. They will not use statements or expressions that may lead to unfair competition. Otherwise, they acknowledge that they will be directly responsible for any damages, losses, expenses, and other claims arising from third parties, as well as any lawsuits. They acknowledge that Complaints.ae has no liability in this regard and that in the event of any harm suffered by Complaints.ae, they will compensate for these damages upon the first request of Complaints.ae. They also grant full authority to Complaints.ae to settle with the party making a claim and agree to bear all expenses, including court costs, attorney's fees, and settlement expenses upon the first request of Complaints.ae.

The USER understands that any complaints submitted through the system will be assessed by Complaints.ae in accordance with applicable legislation, norms and practices, and general morality. They further acknowledge that changes may be made to the content of the complaints and that they will have no claims for reimbursement or similar requests because of such changes.

The USER acknowledges that Complaints.ae is neither obligated nor able to guarantee to resolve all complaints submitted via the system. In addition, they shall be informed that Complaints.ae is not liable for unresolved complaints or any damages incurred as a consequence of the events described in the submitted complaints.

The USER agrees to receive SMS, email, or any other form of messages, news, information, communications, and posts sent by Complaints.ae for newsletters, products, services, campaigns, notifications, content, reports, and any other type of information.

Complaints.ae will terminate and prohibit any account it deems to be associated with sending spam or any other unwanted bulk emails at its discretion. For any inquiries, please contact contact@complaints.ae.

 

7. User Content Responsibilities

The user alone is responsible for the content; once published, it cannot always be withdrawn. By using the site, you assume all risks associated with your content, including anyone's reliance on its quality, accuracy, or reliability. You represent that you own or have the necessary permissions to use and authorize the use of the content as described herein. You may not imply that your content is in any way sponsored or endorsed by Complaints.ae.

Complaints.ae respects the copyrights and intellectual property rights of third parties and expects users to do the same. You may expose yourself to liability if, for example, your content contains material that is false, intentionally misleading, or defamatory; violates any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; contains unlawful material, including illegal hate speech or pornography; exploits or otherwise harms minors, or violates or advocates the violation of any law or regulation. Any content that violates these terms shall not be published and may be removed.

Therefore, the user won't submit stuff they don't hold the copyright for unless they have permission. Otherwise, you will pay all royalties and other amounts owed to any person or entity based on your content or Complaints.ae’s hosting of that content.

The user promises that if Complaints.ae or its users exploit or make use of your submission in the ways contemplated in this agreement, you promise that this will not infringe or violate the rights of any third party, including (without limitation) any privacy rights, publicity rights, copyrights, contract rights, or any other intellectual property or proprietary rights.

User Content (including any that users employed or contracted by Complaints.ae may have created) does not necessarily reflect the opinion of Complaints.ae. We reserve the right (but have no obligation) to remove, screen, edit, or reinstate User Content from time to time at our sole discretion for any reason or no reason and without notice to you. We have no obligation to retain or provide you with copies of your content, nor do we make any representations or warranties or otherwise make any guarantees regarding the confidential treatment of your content.

Users must have used the product or service to leave a comment on Complaints.ae. Even if multiple requests are made regarding the same complaint, users are only allowed to write one comment based on their own experiences. Updates and additions related to the same complaint can be added as comments. Comments should be honest and realistic, avoiding presenting the author's subjective opinion as fact or making false, harmful, offensive, threatening, harassing, obscene, racist, or illegal claims.

 

8. Limitations of Liability for Complaints.ae

In no event shall Complaints.ae be liable for any of the following:

  • any incidental, consequential, or indirect damages arising from the use or non-use of the system, any transaction, service, information, data, or other materials provided or copied through Complaints.ae, or any delays in such information or service (including but not limited to loss of profits, interruption of business, loss of programs or data). This applies even if Complaints.ae or its authorized representatives have been notified of the possibility of such damages.
  • Complaints.ae shall not be responsible for any claims arising from errors, omissions, or other defects in Complaints.ae, or from any writings, materials, or information submitted through its means.
  • The USER is responsible for the proper functioning, maintenance, updates, and all costs, taxes, and financial obligations associated with all telephones, computer hardware, internet, and computer security, as well as the necessary equipment for accessing and using the system. The USER is solely responsible for any damages, claims, or legal actions resulting from their failure to comply with these obligations.
  • If the user violates any provision of this agreement by accessing and utilizing the system, they are liable for all losses, expenses, damages, and costs, including court costs and attorney's fees. Complaints.ae shall not be liable for any of the above.
  • If Complaints.ae determines or has credible evidence that any user’s account is being used for unlawful activities, it reserves the right to disclose the user’s information, including system-related information and activity history.
  • Complaints.ae shall not disclose the personal information provided by users in the individual membership form, which they have filled out themselves, to third parties outside the purposes and scope determined by the Privacy Policy. Personal information includes any information that identifies the user, such as name, address, phone number, and email address, and is collectively referred to as "Confidential Information." Except as defined in this Privacy Policy, Complaints.ae shall not disclose personal information to any company or third party. However, Complaints.ae may share personal information with companies for the purpose of customer profiling, conducting statistical studies, and finding solutions to the complaints received within its own organization and in cases defined in this Privacy Policy.

Complaints.ae is committed to keeping personal information strictly confidential, considering it as an obligation of confidentiality. It undertakes to take necessary precautions and exercise due diligence to ensure the confidentiality and preservation of privacy, prevent the disclosure of confidential information in whole or in part to the public domain or unauthorized use, and prevent its disclosure to any third party. Although Complaints.ae takes necessary information security measures, it shall not be held responsible in the event that confidential information is compromised or falls into the hands of third parties as a result of attacks on the platform and/or system.

Complaints.ae may obtain information about users and their use of the platform using a technical communication file (Cookie). However, users can change their browser settings to prevent the delivery of the technical communication file or receive a warning when the file is sent, if they wish to do so.

Complaints.ae stores information about the use of the site, but this information will only be shared with third parties and other members with the user's permission. Complaints.ae may share or use information with third parties as long as the information is anonymized.

Complaints.ae’s right to use your content:

  • Complaints.ae may use your content in several different ways, including publicly displaying it, reformatting it, incorporating it into advertisements and other works, creating derivative works from it, promoting it, distributing it, and allowing others to do the same in connection with their websites and media platforms ("other media").
  • As the user, you hereby irrevocably grant us worldwide, perpetual, non-exclusive, royalty-free, assignable, sub-licensable, transferable rights to use your content for any purpose.

You also irrevocably grant the users of the site and any other media the right to access your content in connection with their use of the site and any other media.

Finally, you irrevocably waive and cause to be waived against Complaints.ae and its users any claims and assertions of moral rights or attribution concerning your content. By "use" we mean use, copy, publicly perform and display, reproduce, remove, distribute, modify, edit, translate, analyze, commercialize, and prepare derivative works of your content.

 

9. Removal of Information and Content

Complaints.ae acts as a platform for a permanent record of disputes, including resolved and unresolved complaints. When you post a complaint or a comment on our platform, it becomes subject to our Terms and can be used and stored as permanent material by Complaints.ae. When posting, you also agree and understand that the information you post cannot be deleted even at your request. Accounts associated with the email address you used to sign up are not removed either. You shall remain solely responsible for the content of your postings on Complaints.ae. While we do not and cannot review every message posted by users of the Service and are not responsible for any content of these messages, we reserve the right. Still, we are not obligated to delete or remove profanity, obscenities, physical violence threats, property damage, and private financial information such as social security numbers and credit card information.

10. Surveys

The site and related platforms may occasionally conduct surveys to gather user feedback and improve our services. Participation in surveys is voluntary, and by participating in such surveys, you agree to share your opinions and experiences.

You guarantee and declare that all information provided during your survey participation is accurate and complete. The information collected in surveys will be used and processed in accordance with our privacy policy.

Complaints.ae reserves the right to publish survey results and statistics on the website and other channels. By participating in surveys, you agree to the use of anonymized data in this manner.

Any rewards or incentives (if applicable) specified in the surveys will only be provided in accordance with the terms and conditions of the survey as determined by Complaints.ae, within the specified timeframe. You are purely responsible for the use of rewards and incentives; we assume no responsibility for their application.

 

11. Intellectual Property Rights

The site, site content, features, and functionality are owned by Complaints.ae and are protected by copyright, trademarks, and other intellectual property rights. You promise not to reproduce, duplicate, copy, sell, or otherwise use the site or any part of it without the written permission of Complaints.ae.

 

12. Special Notice for International Use

Given the worldwide nature of the Internet, users accept and agree to abide by all local laws and regulations, including but not limited to the Internet, data, electronic mail, and privacy requirements. All users agree to abide by the rules and regulations of United Arab Emirates or their home country.

 

13. Third-Party Relationships in Terms of Users

Once you follow a link to another website, our responsibility to inform you and protect your information is over. Complaints.ae may contain links to other websites, including the companies you want to communicate with. These can also include links to consumer rights information, discounts, coupon codes, and cash-back services. When you access third-party websites, you do so at your own risk. We don't control or endorse those sites.

Any relationship between the user and any third party, including the provision of goods and services, payment, delivery, and any other terms, conditions, warranties, or representations, as well as the user’s participation, correspondence, business dealings, or any other type of relationship, is solely between the user and the third party. The user recognizes that. Complaints.ae is not liable for any loss, damage, or other sorts of claims resulting from such a relationship or matter.

 

14. Advertising

Complaints.ae and its licensees may publicly display advertisements and other information adjacent to or include with your content. You are not entitled to any compensation for such advertisements. The manner, mode, and extent of such advertising are subject to change without specific notice to you.

 

15. Resolution of Disputes and Applicable Laws

Any conflicts, disagreements, or claims resulting from or related to the application, termination, or invalidation of the rules must be handled by dialogue between the Parties. The Party bringing a claim and/or dispute must send a message to the other Party outlining the claims and/or disputes. If the Parties are unable to agree on the claims and/or disputes that have arisen, the matter will be decided in the court located in the jurisdiction where Complaints.ae is based.

The Parties agree and undertake that United Arab Emirates laws and regulations shall apply to the resolution of any disputes arising from this agreement, as well as to the implementation and interpretation of the entire agreement or its parts.

For any claim brought by either party, you agree to submit and consent to the personal and exclusive jurisdiction in the exclusive venue of Dubai, United Arab Emirates.

 

16. Limitation of Liability and Force Majeure

The site is made available to you on an "as is, " "with all faults," and "as available" basis, with the express understanding that Complaints.ae entities may not review, monitor, control, or vet user content. Your use of the site is at your own discretion and risk. Complaints.ae entities make no claims or promises about the quality, accuracy, or reliability of the site, its safety or security, or the site content. Accordingly, the Complaints.ae entities is not liable to you for any loss or damage that might arise, for example, from the site's inoperability, unavailability, or security vulnerabilities or from your reliance on the quality, accuracy, or reliability of the business listings, ratings, reviews (including their content, order, and display), or metrics found on, used on, or made available through the site.

Complaints.ae entities make no claims or promises concerning any third party, such as the businesses or advertisers listed on the site or the site's users. Accordingly, the Complaints.ae entities is not liable to you for any loss or damage that might arise from their actions or omissions, including, for example, if another user or business misuses your content, identity, or personal information or if you have a negative experience with one of the businesses or advertisers listed or featured on the site. Your purchase and use of products or services offered by third parties through the site are at your own discretion and risk.

Complaints.ae entities expressly disclaim all warranties, whether express or implied, including warranties as to the products or services offered by businesses listed on the site and implied warranties of merchantability, fitness for a particular purpose, and non-infringement. No oral or written information or advice provided to you by a representative of one of the Complaints.ae entities shall create a representation or warranty.

Your sole and exclusive right and remedy in case of dissatisfaction with the site, related services, or any other grievance shall be your termination and discontinuation of access to or use of the site.

Complaints.ae does not accept liability for (i) indirect, special, incidental, punitive, exemplary, reliance-based, or consequential damages, (ii) loss of profits, (iii) business interruption, (iv) loss of reputation, or (v) loss of information or data.

As per the relevant laws, Complaints.ae cannot be held responsible for any indirect, incidental, special, non-compensatory, or punitive damages. This includes any direct or indirect loss of profit or revenue, loss of data, loss of use, loss of goodwill, or other intangible losses that may arise from your use of the Platform.

The user acknowledges, declares, and agrees that Complaints.ae has no obligation or guarantee with respect to the resolution of complaints and feedback submitted to the website and associated platforms. Similarly, Complaints.ae is not liable for unresolved complaints or damages sustained because of events occurring to the user’s detriment.

Any event (such as a fire, earthquake, flood, natural disaster, war, etc.) that occurs after the user accepts this agreement and prevents or makes it impossible for Complaints.ae to fulfill its obligations and commitments under this agreement or makes it impossible to fulfill them in a timely manner, shall be considered force majeure. The user agrees, declares, and contracts that if Complaints.ae is unable to meet its obligations due to force majeure, the user will not hold Complaints.ae responsible or liable.

 

17. Entry into Force and Term of Agreement 

This agreement shall enter into force upon the user performing one or more of the following actions: (a) browsing, accessing, searching, or otherwise using the platform, (b) clicking on a checkbox or button, or (c) providing any other affirmative confirmation indicating acceptance of these terms.

These terms shall remain in full force and effect for the duration of your use of the Complaints.ae website or services. Complaints.ae may terminate these Service Terms by publishing them on the Complaints.ae website for any reason.

Complaints.ae reserves the right to terminate your access to the website without notice, including for any breach of this Agreement. Complaints.ae may close your account, suspend your ability to use certain sections of the site, and/or ban you from the platform for any reason or no reason at all, without providing any notification or assuming any liability. Such action may block your access to your account, the site, your content, site content, or other relevant information.

In the event of termination of these terms by you or Complaints.ae, all sections of the agreement shall continue to be fully effective, including the right to use user content.

If any provision of these terms is found to be invalid under applicable laws, that provision shall be limited or eliminated to the minimum extent necessary to allow the remaining provisions of the terms to remain in full force and effect. The failure to exercise any right provided in these terms by you or Complaints.ae shall not be deemed a waiver of any other rights.

These Terms are personal to you. You can't assign, transfer, or sublicense them unless you get Complaints.ae ‘s prior written consent. Complaints.ae has the right to assign, transfer, or delegate any of its rights and obligations under these Terms without your consent. Complaints.ae will provide you a notice via email, written notice, or by conspicuously posting the notice on our Site.

 

18. Validity of Complaints.ae Records

The user acknowledges, declares, and undertakes that in any dispute arising from this agreement, the records of Complaints.ae's books and computer systems shall be deemed valid, binding, conclusive, and exclusive evidence. This provision is considered as a contractual provision regarding evidence.

 

19. Definitions

Comment: refers to the written contributions shared by users on the platform to express their thoughts about content or product.

Complaint: consists of user-generated entries on the site where member users share their experiences related to being dissatisfied with a product or service. Complaints can arise from various reasons, such as product quality, service delivery, customer service, and pricing.

Content: text, image, photo, audio, video, and all other forms of data or communication, as well as data and inputs that can be obtained through analysis or other methods including AI generated content.

Likes: Users’ way of expressing their approval or liking for content using the provided marking on the platform.

Member: refers to users who become part of the membership system by accepting the terms and conditions of use and benefiting from the services limited and provided by the site.

Member Content: refers to all content, including text, image, photo, audio, video, and other forms of content sent or transmitted by registered members to the website through the site. Members have usage, managing, and viewing rights for this content as determined by the site.

Platform: collectively refers to the complaints.ae website, its derivative sites, mobile applications, or any other extensions on various platforms.

Service: the entirety of benefits and features provided to users based on the purpose, target audience, and needs of the site.

Complaints.ae: the overall identity of the platform as a service provider.

Site: refers to the platform and pages that users can access by visiting https://complaints.ae and its extensions.

Site content: refers to all content made available within the site and in connection with the site, including visitor content, member content, and third-party content.

Survey: Complaints.ae’s research method to gather user feedback, preferences, experiences, and opinions.

System: a combination of software and hardware components used to ensure the site's functionality. These components form the infrastructure that manages site content, user interactions, data storage, and analysis, as well as security and performance.

Third-Party: Entities other than the platform itself and its users (advertisers, analytics providers, payment processors) or other service providers or parties mentioned in member content.

Third-Party Content: site content presented to users as stated in the terms of use agreement.

User: registered members and unregistered visitors accessing the site, as well as anyone browsing or fully utilizing the services.

Visitor: refers to users who are not registered in the member system but have access to view site content.

Visitor Content: refers to the limited content publicly displayed on the site, including member comments and complaints, as well as the content created and shared by the site for viewing purposes. This content may include text, visuals, videos, audio recordings, or any other type of materials.
